Counsel for the Government needed to discuss certain options with its client. On August 31, 2005, at 12:00 noon, the Court held another conference call on the record with the parties to discuss the issues raised in Petitioners' Motion for Temporary Restraining Order, and the proposals by the Government and Petitioners as to a resolution. Pursuant to that discussion, the parties have agreed that counsel for Petitioners shall schedule a visit with at least 4 detainees, arriving September 12, 2005, interviewing on September 13-14, and possibly September 15, and then departing on September 16, 2005. Counsel for the Government has indicated that it understands from its client that a visit would also be possible this coming weekend, September 3-5, 2005, and shall confirm this, with the understanding that an additional visit would allow Petitioners' counsel to meet with additional detainees. Counsel for Petitioners shall determine whether an additional visit this weekend would be feasible, and the parties shall communicate with each other about scheduling such a visit. In addition, counsel for Petitioners shall provide the Government with a prioritized list of detainees they propose to interview, and the parties shall negotiate in good faith over the number of interviews that can be scheduled during Petitioners' counsel's visit(s). If the parties are unable to reach a resolution, the Government shall file its response to Petitioners' Motion for Temporary Restraining Order by 5pm on Tuesday, September 6, 2005.
