2003.12.18 -- PEGC Update ========================= The US Court of Appeals for the Second Circuit issued a 2-1 decision in favor of Jose Padilla today. I haven't even read it yet, but it's the first victory in any of the habeas cases and the best news we've had in two years. The biggest battles are still ahead, but Donna Newman, Andrew Patel, and their amici have done a great job on this case and I'm optimistic they can and will prevail in the end. The 2nd Circuit opinion and dissent are available on this page: http://www.ca2.uscourts.gov/NewOpn.htm They are also saved on the PEGC website in the Padilla folder at: http://PEGC.no- ip.info/geneva_project/archive/Padilla_vs_Rumsfeld/2d_Cir_03-2235_o pn.pdf http://PEGC.no- ip.info/geneva_project/archive/Padilla_vs_Rumsfeld/2d_Cir_03-2235_d is.pdf CNN -- December 18, 2003 COURT: PRESIDENT CANNOT DETAIN U.S. CITIZEN AS ENEMY COMBATANT http://www.cnn.com/2003/LAW/12/18/padilla.case/index.html Washington Post -- December 18, 2003 - 12:17 PM EST COURT: U.S. CANNOT HOLD PADILLA AS A COMBATANT By Larry Neumeister, The Associated Press http://www.washingtonpost.com/wp-dyn/articles/A11500-2003Dec18.html Regards, Charly * * * Charles Gittings Oakland, California +1-510-923-1688 cbgittings@sbcglobal.net Project to Enforce the Geneva Conventions (PEGC) http://PEGC.no-ip.info/ PEGC Update http://PEGC.no-ip.info/PEGC_Update.html
